Article 1 — Definitions

In these terms, the following definitions apply:

  • Trader: CNL Handel BV, trading as Karpet24
  • Consumer: the natural person who is not acting in the course of a trade, business or profession and who enters into a distance contract with the trader
  • Distance contract: a contract whereby, within the framework of a system organised by the trader for the distance sale of products, exclusive use is made of one or more means of distance communication up to and including the conclusion of the contract
  • Right of withdrawal: the option for the consumer to withdraw from the distance contract within the cooling-off period
  • Cooling-off period: the period within which the consumer may exercise his right of withdrawal
  • Day: calendar day
  • Durable medium: any means that enables the consumer or trader to store information addressed to him personally in a way that allows future consultation and unaltered reproduction of the stored information

Article 3 — Applicability

  1. These terms and conditions apply to every offer made by Karpet24 and to every distance contract concluded between Karpet24 and the consumer.
  2. Before the distance contract is concluded, the text of these terms and conditions is made available to the consumer. The consumer may consult, save and print these terms at any time via our website.
  3. Situations not covered by these terms and conditions shall be assessed "in the spirit" of these terms and conditions.
  4. Any uncertainty about the interpretation or content of one or more provisions of our terms shall be interpreted "in the spirit" of these terms and conditions.

Article 4 — The offer

  1. If an offer has a limited validity period or is subject to conditions, this will be expressly stated in the offer.
  2. The offer contains a complete and accurate description of the products offered. The description is sufficiently detailed to enable the consumer to assess the offer properly. Images are a true representation of the products offered. Colours on your screen may differ slightly from the actual colour of the rug; no rights can be derived from this.
  3. Obvious mistakes or errors in the offer are not binding on Karpet24.
  4. Each offer contains such information that it is clear to the consumer what rights and obligations are attached to acceptance of the offer.

Article 5 — The contract

  1. The contract is concluded at the moment the consumer accepts the offer and meets the conditions set therein.
  2. If the consumer has accepted the offer electronically, Karpet24 will promptly confirm receipt of the acceptance electronically.
  3. Within statutory limits, Karpet24 may inform itself as to whether the consumer can meet his payment obligations and of all facts and factors important for entering responsibly into a distance contract. If, on the basis of this investigation, Karpet24 has good reason not to enter into the contract, it is entitled to refuse an order or request, or to attach special conditions to its performance.

Article 6 — Right of withdrawal

  1. When buying products, the consumer has the option to dissolve the contract without giving reasons during 14 days. This cooling-off period starts on the day after the consumer receives the product.
  2. During the cooling-off period, the consumer will handle the product and packaging with care. The consumer will only unpack or use the product to the extent necessary to establish the nature, characteristics and functioning of the product. The principle is that the consumer may only handle and inspect the product as he would be allowed to do in a shop.
  3. The consumer is liable for any decrease in the value of the product resulting from handling that goes beyond what is permitted in the previous paragraph.
  4. If the consumer exercises his right of withdrawal, he will notify us within the cooling-off period by email to info@karpet24.nl. After this notification, the consumer must return the product within 14 days. The consumer must prove that the goods were returned in time, for example by means of a proof of shipment.

Article 7 — Costs in the event of withdrawal

  1. If the consumer exercises his right of withdrawal, no more than the costs of returning the goods will be at his expense.
  2. If the consumer has paid an amount, Karpet24 will refund this amount as soon as possible, but at the latest within 14 days of withdrawal. Refunds will be made via the same payment method used by the consumer, unless the consumer expressly consents to a different payment method.
  3. If the product is damaged due to careless handling by the consumer, the consumer is liable for any decrease in the value of the product.

Article 8 — Exclusion of the right of withdrawal

The right of withdrawal is excluded for:

  1. Products manufactured to the consumer's specifications, that are not prefabricated and that are made on the basis of an individual choice or decision by the consumer, or that are clearly intended for a specific person (for example rugs cut or made to measure);
  2. Products that perish quickly or have a limited shelf life;
  3. Sealed products which, for reasons of health protection or hygiene, are not suitable for return and where the seal has been broken after delivery;
  4. Gift cards.

Article 9 — The price

  1. The prices stated in the offer of products include VAT, unless expressly stated otherwise.
  2. All prices are subject to printing and typesetting errors. No liability is accepted for the consequences of printing and typesetting errors. In the event of printing and typesetting errors, Karpet24 is not obliged to deliver the product at the incorrect price.
  3. Prices and offers do not automatically apply to repeat orders and/or future orders.

Article 10 — Conformity and warranty

  1. Karpet24 guarantees that the products comply with the contract, the specifications stated in the offer, the reasonable requirements of soundness and/or usability, and the statutory provisions and/or government regulations in force on the date the contract is concluded.
  2. All products from Karpet24 are covered by the statutory warranty. Statutory warranty means that a product is or must do what the consumer can reasonably expect from it. For rugs, in normal household use, this means an expected lifespan of several years, depending on the type and quality of the rug.
  3. Wear from normal use, fading from sunlight, damage caused by improper use or insufficient maintenance are not covered by the warranty.

Article 11 — Delivery and performance

  1. Karpet24 will exercise the greatest possible care in receiving and fulfilling orders for products.
  2. The place of delivery is the address that the consumer has notified to Karpet24.
  3. Karpet24 will fulfil accepted orders with appropriate speed. In practice, in-stock products are delivered within 1–6 business days — see our shipping policy for current delivery times per destination. The statutory maximum delivery period is 30 days, unless a longer period has been expressly agreed. If delivery is delayed, or if an order cannot be fulfilled or can only be fulfilled in part, the consumer will be notified of this no later than 30 days after placing the order.
  4. The risk of damage to and/or loss of products rests with Karpet24 until the moment of delivery to the consumer.

Article 12 — Payment

  1. Unless otherwise agreed, the amounts owed by the consumer must be paid immediately when placing the order via the payment methods offered at checkout (including iDEAL, Wero, Apple Pay, Google Pay, Klarna, Visa and Mastercard).
  2. The consumer has a duty to report any inaccuracies in payment details provided or stated to Karpet24 without delay.

Article 13 — Complaints procedure

  1. Karpet24 has a sufficiently publicised complaints procedure and handles complaints in accordance with this procedure.
  2. Complaints about the performance of the contract must be submitted to Karpet24 fully and clearly described, within a reasonable period after the consumer has identified the defects, by email to info@karpet24.nl.
  3. Complaints submitted to Karpet24 will be answered within 14 days from the date of receipt. If a complaint requires a foreseeably longer processing time, Karpet24 will respond within the 14-day period with an acknowledgement of receipt and an indication of when the consumer can expect a more detailed reply.
  4. If the complaint cannot be resolved by mutual agreement, a dispute arises that is open to the dispute resolution procedure.

Article 14 — Disputes

  1. Contracts between Karpet24 and the consumer to which these terms and conditions apply are governed exclusively by Dutch law, even if the consumer is resident abroad.
  2. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.
  3. Consumers can also submit their complaint via the European ODR platform (ec.europa.eu/consumers/odr).

Article 15 — Additional or differing provisions

Additional provisions or provisions deviating from these terms and conditions may not be to the detriment of the consumer and must be recorded in writing, or in such a way that they can be stored by the consumer in an accessible manner on a durable medium.

Dutch Home Shopping Terms (Thuiswinkel)

These Terms have been drafted in line with the Algemene Voorwaarden Thuiswinkel, the Dutch industry standard agreed with the Consumers' Association (Consumentenbond) under the auspices of the Social and Economic Council. In the event of any conflict, the most consumer-friendly interpretation prevails.

Complaints about the performance of an agreement should be submitted to us within a reasonable time — fully and clearly described — at info@karpet24.nl. We respond within 14 days of receipt.

Prices and discounts (Omnibus Directive)

For any price reduction, we display the original price and the lowest price the product has had with us in the 30 days preceding the discount, in accordance with the EU Omnibus Directive (art. 6:193g Dutch Civil Code).
